Health Care Surrogate Designation
The Health Care Surrogate Designation is very similar to the durable power of attorney; however, the person designated is able to make medical decisions on the behalf of the person without capacity.
The Health Care Surrogate Designation only comes into effect when the person without capacity cannot express their desires as to medical treatment. It is critical that a HIPPA release is also signed naming all potential health care surrogates or there may be difficulty for the health care surrogate to get all facts necessary to make informed medical decisions on your behalf.
Common inclusions in this designation are when to stop treatment (or take off of life support) and who will make medical decisions – such as treatment for illness.
